Labor Issues: Hiring and Firing

We advice employers as to the legal and procedural requirements with respect to laying off an employee.

We help employees who are threatened with being or have already been laid off, to identify their rights under French law and, if necessary, to enforce them against the employer. Often, an employment contract states that the law of some other country governs the employment relationship between employer and employee. This may not be the case in law, that is, the labor court may conclude that notwithstanding the terms of the contract, the French labor law applies to the contract - which is usually to the decided advantage of the employee. We help to negotiate a settlement with the employer and if settlement is not possible, we can represent you before the labor court. We can also help you to understand how the French tax law offers special tax benefits to severance pay settlements. We can help you to report the severance pay in the U.S. on your U.S. income tax return and to explore whether any portion of it may qualify for special tax treatment.
